How many days of paternity leave can I draw if I don’t work full time (part-time worker)?

Example: You work 60 % on 3 days a week. To have a week off, you need 3 vacation days. In the same way the entitlement to paternity leave is calculated for part-time workers.

Therefore, a father with a 60 % work quota can stay at home for 6 days (2 x 3 days). For each 3 days 2 additional days off are credited. If he draws these 6 days, he is entitled to 14 daily benefits.

What documents do I have to enclose to the Paternity Allowance Application Form?

The family pass or an equivalent official document.

The pay slips for the last 12 months before the birth of the child.

In case of payment directly to the insured person: the current residence permit, if no residence permit C or a Swiss citizenship exists.

How do I proceed if I have several employers?

For the principal employer you can fill in the Paternity Allowance Application Form (318.747). For all other employers please use the Supplementary Paternity Allowance Application Form (318.748). You can find both under the heading «Forms» on our homepage www.exfour.ch.

Before the birth I was unemployed. How do I proceed?

Please submit the Maternity Allowance Application Form to the last employer before your unemployment. He will fill in all the information in part B. Afterwards please send the form together with the last statement of the unemployment office and the family pass to our compensation office.

When do I have to declare that my child had to stay at the hospital immediately after birth?

As soon as the child is hospitalized all the time for at least 14 days immediately after birth, you are entitled, under certain conditions, to additional daily maternity allowances up to a maximum of 56 days. Please submit a medical certificate for the child that indicates the day of the discharge from the hospital together with the application for the maternity allowance.

A further basic requirement is that the mother would have taken up working again after the delivery. This has to be confirmed by the employer in question.

For mothers with indemnifications (accident/sickness/unemployment benefits) special conditions apply.

Who pays the maternity allowance?

If you continue receiving a salary, the employer will receive the maternity allowance from our compensation office.

If you do not receive a salary anymore, we will transfer the maternity allowance directly to a bank/postal account of your choice. In addition, we will enter your daily benefits in you Individual Account.

Do I have to complete a Maternity Allowance Application Form for all current employers?

Yes, in order to be able to correctly calculate the daily benefits, we need the exact information of all employers.

For the principal employer you can fill in the Maternity Allowance Application Form (318.750). For all other employers please use the Supplementary Maternity Allowance Application Form (318.751). You can find both under the heading «Forms» on our homepage www.exfour.ch.

Why do I have to declare for what period of time I have received sickness or accident benefits?

This is very important for the calculation. For the determination of your daily benefits the last salary you earned without health restriction is taken into account.

In addition, you are entitled to daily benefits in the same amount if you received a daily sickness indemnity according to LAMal or an accident indemnity according to LAI (Protection of vested rights).

When does the division of pension rights have to be executed?

This is possible as soon as the divorce has come into force. You can then submit the application form for income splitting upon divorce (318.269) to us. Please provide a copy of the divorce decree mentioning the date of marriage, the date the divorce has come into force and the adjudication of children, if any.

At the latest upon the occurrence of the pension contingency of one of the parties the division of pension rights will be executed officially.

Does the division of pension rights upon divorce have an effect on the amount of my pension?

There is no general answer. The incomes are divided during every full year of the marriage except for the year of the marriage and the year of the divorce. Consequently there is a compensation of incomes during the marriage. This will be entered in your Individual Account.

Does my ex-partner gain insight into my incomes?

As the halved incomes for every full year of the marriage are entered in the Individual Account, it is possible to draw conclusions as to the income.

Is the division of pension rights upon divorce obligatory?

Yes, it cannot be waived. It will be executed officially before the occurrence of the insured event of the first party involved.

Which compensation office is competent for my splitting?

Any compensation office keeping an Individual Account for you can execute the division of incomes upon divorce for you.

Leaflet 3.06

Which calculations will be carried out by default?

The calculation of the pension upon achievement of the 65th year for men and the 64th year for women will always be made. You can ask for additional variants to be calculated on the last page of the application form.

Which additional calculations can be requested?

We can calculate an early withdrawal of 1 or 2 years. In addition we can simulate a divorce and calculate a hypothetical pension. It is also possible to calculate the amount of a pension in case of a postponement of the retirement.

Should you wish to reduce your work schedule or if you become unemployed, these facts can also be taken into account for the calculation. Likewise it is important for us to know if you want to leave Switzerland and then contribute to the voluntary insurance or not.

When does my partner have to submit an application for a pension forecast?

Once you are married, we always calculate the pension for both partners. When the second insured event occurs (ordinary retirement age, early withdrawal or postponement) the previous pension is also recalculated for the spouse entitled to the first pension. It is therefore important to know the amount of the pensions.

Why do I have to declare children (legitimate, born outside marriage, adopted, stepchildren) over the age of 16?

On the occasion of the calculation of the pension, educational credits are taken into account. You receive educational credits from the year after the birth of the first child up to the accomplishment of the 16th year of age of the youngest child, if you have the child custody (sole or joint).

How long does it take to execute a pension forecast?

If we have all necessary documents, you will receive a written answer within 3 weeks. If one or more divisions of pension rights have to be carried out, the answer can be somewhat delayed.

How do I request a statement of my Individual Account?

Click the heading «Individual Account statement» on our homepage www.exfour.ch. In the top section, choose the appropriate answer as to whether you live in Switzerland or not. Now the application form opens automatically, and you can complete it and send it off.

What kind of information is contained in my statement of Individual Account?

All salaries subject to OASI entered to date. The salaries of the current year will only be entered during the course of the following year.

In addition the name of the employer and the duration of the employment is listed. If a division of pension rights has been executed, you can also see the added and deducted incomes. Should you be entitled to care-taking benefits, you can see the quotas you’re entitled to. The actual amounts will be determined when the insured event occurs.

Where can I get an insurance certificate?

Please contact your employer. He can order a new insurance certificate anytime via our internet platform «connect».

How do I proceed if I do not agree with the income entries?

Check the column «Kassen-Nr./Caisse No./Cassa No.» to find out which compensation office is responsible. You can submit a copy of your salary statement or a similar document that supports your claim. The compensation office will then investigate the matter and reply to you in writing.

How do I modify the entry/leaving date of an employee?

Please consult our manual «connect».

Why do you need the apprentice’s IBAN number when the indemnity is paid to the employer ?

For the recruitment a person with no children receives Fr. 62.00 per day. The employer receives only the share of the salary converted to the day. The share exceeding the salary has to be paid directly to the insured person.

Is each parent entitled to 98 days ?

No, the entitlement is caused by the heavily impaired child. The two attachment figures together are entitled to 98 days if working full time. The division is left to the attachment figures. If they cannot come to an agreement, each is entitled to 49 days.

When should I register for the old-age pension?

We recommend that you register about 6 months before reaching the regular retirement age. If you want to take your old-age pension early by 1 or 2 years, you will have to register 1 or 2 years prior to reaching the regular retirement age (men = 65, women = 64). If you take the old-age pension early by 2 years, your pension will be reduced by 13.6 percent, if you take the old-age pension early by 1 year, your pension will be reduced by 6.8 percent.

What documents do I have to submit upon leaving Switzerland?

Please send us a copy of the confirmation of departure from your municipality as well as your new address abroad.

In whose name does the account the pension is paid to have to be registered?

The account has to be registered in the name of the insured person, or to a joint account in case of married couples. If the pension is to be paid out to a third party we need a corresponding request. You can find the form on our website www.exfour.ch à Formulare à Allgemeine Verwaltungsformulare, Gesuch um Drittauszahlungen von Leistungen der AHV/IV/EO/EL/FZL (318.182 available in German, French and Italian).

Guidelines regarding pensions (RWL) as of 01.01.2018

Margin no. 3368

As the start of an education the time of a person’s providing the required educational efforts is relevant (margin no. 3360), e.g. attending lectures and courses. Therefore, not the official start of a term (as per the confirmation of matriculation) is considered the start of the studies, but the actual time the studies are taken up (BGE 141 V 473).

Margin no. 3368.1

The official end of the studies occurs as soon as the person doesn’t provide any educational effort anymore, because all necessary evidence of academic achievement for the graduation have been produced (papers submitted, internships completed, exams passed). The official end of the studies (e.g. de-registration, graduation or doctoral awards ceremony) is not relevant.

Note

In case of changes to the current education, of dropping off or of additional earned income of the child we ask you to let us know immediately.

Cantonal differential allowances: Please submit the certificate of education to the family allowance office competent for the basic allowances.

Is insurance protection still guaranteed in case of an existing illness and current daily sickness allowances, if the employer terminates the contract?

Yes, if the contract is terminated during the entitlement to benefits the insurance cover expires at the end of the incapacity for work attested by a doctor, at the latest with the exhaustion of the entitlement to benefits.

Why do I have to sign a power of attorney?

In order to assess the entitlement to benefits the relevant medical facts have to be verified. The power of attorney is required in order to obtain information from the attending doctor if necessary or for the exchange with other social insurance partners (invalidity insurance, accident insurance etc.)

Do I really have to register with the invalidity insurance? I don’t want to receive an invalidity pension.

Yes, a registration should be made as early as possible, i.e. as soon as it becomes apparent that the damage to health could cause a right to benefits of the invalidity insurance as integration measure, pension, helplessness allowance etc. In case of a tardy registration, the benefits will as a rule only be paid for the 6 month prior to the registration. A registration therefore has to be presented within 6 months from the beginning of the incapacity for work at the competent IA office.

I would like to go on long-awaited holidays during the incapacity for work. Will the daily sickness allowance be paid during my holidays?

Incapacity for work due to sickness and holidays are basically mutually exclusive. In case the attending physician declares the insured person fit for holidays despite the illness, no daily indemnities will be paid for the duration of the holiday. In case of holidays abroad, there are special regulations to be observed: Insured persons travelling abroad during a sickness without consent of the compensation office are not entitled to any benefits from the compensation office during their stay abroad. The consent of the compensation office has to be obtained in good time and in any case before the planned departure.

Why do you recommend a transfer to an individual insurance?

The protection in case of an incapacity for work due to sickness during unemployment is insufficient if the sickness lasts longer.

Will contributions to the social security insurances be levied on daily sickness allowances?

No, daily sickness allowances are exempt from contributions to the social security insurance. To avoid possible gaps in contributions please contact the competent compensation office for clarification. You might have to pay OASI contributions as an inactive person.

For how long are benefits of the daily indemnity insurance paid out?

Provided that the relevant requirements are fulfilled, the daily sickness indemnities are paid out in line with the regulatory eligibility period for no longer than 720 days minus the deferral period (e.g. 30 days) agreed upon.

Do the originals of the medical certificates have to be provided?

No, a copy is sufficient.

Is there an entitlement to daily sickness indemnities for the duration of a maternity allowance?

There is the entitlement to the payment of a possible differente, i.e. if the daily sickness indemnity is higher than the maternity allowance, there is an entitlement to the difference.

A family member is ill. Is there an entitlement to daily sickness allowance in order to be able to nurse the person?

No, the entitlement to daily indemnities relates only to the incapacity for work due to illness of the insured person.

When are the daily sickness indemnities paid out?

Provided that the relevant requirements are fulfilled, the daily sickness indemnities are paid at the end of each month.

Am I insured against sickness through the unemployment insurance during a period of unemployment?

Yes, provided that the conditions of entitlement are fulfilled, there is an entitlement to the whole daily indemnity. This lasts no longer that up to the 30th day after the beginning of the total or partial incapacity for work and is limited to 44 daily indemnities within the time frame.
